We will not be responsible, or liable to any third party, for the content or any materials used by you or any other user on our site or using our streaming services..
All licensing, copyright issues are the sole responsibility of the individual user and/or their production entities. We have the right to remove any material or posting the user makes on our site and/or even close the user's account if in our opinion, such material does not comply with our content standards. Remember you (the user) is the only one that is responsible for the content, and the streaming broadcast. In addition, by using our service(s) the user agrees to take the responsibility for any improper use of the content you supply.
Quality DJ Streaming does not offer nor provide any form of legal assistance to user, individuals, and/ or companies who uses our service(s) to distribute content with any copyright protection. Under no circumstances will Quality DJ Streaming be responsible for the actions of its users found to be broadcasting protected content. All licensing, copyright and royalty issues are the sole responsibility of the individual user of our service(s).
Quality DJ Streaming makes a reasonable effort to ensure the security of user's uploaded data. However, in an effort to maintain our low and affordable pricing, we do not offer data backups at this time. Therefore, all data that the you, the user, uploads to our server(s) will be at your own risk. We cannot and will not assume any responsibility for data loss, damage, or corruption of files hosted on our server(s).
All live streaming subscriptions purchased from Quality DJ Streaming comes with an unmetered bandwidth. Various bitrates are offered: 32 kbps, 48 kbps, 64kbps, 128kbps, and 224 kbps. If, in the event, the user chooses to stream above the purchased bitrate on a live server, they run the risk of their stream being interrupted, suspended, and/or terminated for bitrate abuse. The server automatically checks every 5 minutes for streaming above the allotted bitrate and reports to us of the bitrate overages.
If your stream is interrupted for this reason, you will be required to contact tech support in order to have your stream reactivated. A restart fee of $15.00 will be accessed.
Quality DJ Streaming offers a full version of Sam Broadcaster Pro and other Spacial products through the Spacial affiliate Program. However, we accept no responsibility or liability in connection with any software owned or controlled by Spacial or any other third party.
Quality DJ Streams does not provide any music for users to stream However, there are two royalty free sample files placed at setup so the user will know what folder to upload music files to and/or start the AutoDJ services (Auto DJ plans only). It is up to the user, to obtain, purchase and license any software or music that they use or upload for streaming.
By using this service, the user agrees to take full responsibility for the content streamed or hosted on the service.
Quality DJ Streaming does not necessarily monitor any stream content. Therefore, all content broadcast is the sole responsibility of the user.
Again, we do not provide any form of legal cover to individuals or companies who utilize our services to distribute content with any copyright protection.
Under no circumstances will Quality DJ Streaming be responsible for the content uploaded or broadcast by our clients.
All licensing, copyright and royalty issues are the sole responsibility of the individual clients and/or their production entities.
If contacted by an authority in the event of an illegal situation, we will cooperate fully in any investigations they decide to make against clients found to be breaking the law.
All data is stored at client's own risk and we will take no responsibility for any loss, damage or corruption of files hosted on our servers.
User agrees not to engage in any activity that can overwhelm our servers with heavy usage, or that requires a disproportionate amount of resources of its servers, including but not limited to, highly active CGI or chat scripts; Server processing and bandwidth resources are shared with other users and clients are required to understand this.
We reserve the right to monitor, restrict, suspend clients found to be using a disproportionate level of shared resources on a regular basis.
You may not use our services to distribute racial, abusive, or illegal material.
Users are allowed to use our services in virtual games e.g. RLC (Utherverse) and Second Life, but only in properties owned by them. Users can use services if broadcasting out side owned properties but in one location. at a time. The user is allowed to add as many DJs (broadcasters) as desired to perform on their own properties. They are NOT allowed to let other DJs use their streaming service for themselves outside of their properties. Sharing streams for multiple users is strictly prohibited. Failure to comply with this policy will result in immediate termination of services. In addition, the user agrees not to resale his stream or become a provider for another company including their own. Violation of this will result in termination at the end of payment cycle or immediately.
In the event a plan contains bandwidth limits, a user can use up to the maximum bandwidth that is included in the plan..
If the user attempts to use a higher bandwidth without upgrading his package, his account would be suspended or terminated. Currently all our subscriptions contain unmetered bandwidth. Many providers use the term "unlimited." However, there is no such thing as 'unlimited' because everything has a limit of some kind. Unmetered simply means that bandwidth is not monitored unless abused. If in the event bandwidth is abused, the user will be notified and required to make modifications.
All subscriptions are set up on a pre-pay type basis. Services are billed on a monthly, quarterly, semi-annual, and annually basis.
Payments are due on the same day that service was set up (unless other agreements have been made). Payments are made via PayPal, Stripe Payment Center, Virtual Currency (RAYS/Lindens), or any other payment gateway Quality DJ Streaming chooses to incorporate. Payment method is established when the client account is setup. Payment method can be changed by contacting Quality DJ Streaming no less than 15 days before the payment is due.
All payments are in U.S. currency (except for Virtual currency).
Only after Quality DJ Streaming receives the payment, and order approved by staff, will service(s) be provided..
All pricing is guaranteed for the term of pre-payment subscription chosen. Quality DJ Streaming reserves the right to change prices at any time, unless other terms have been agreed upon.
All payments of existing users are non-refundable. Any user desiring to cancel services must contact the billing department either through the support area or by email (pay@qualitydjstremaing.com) at least 7 days before their next billing date.
Cancelling a PayPal subscription directly from your PayPal account without notifying Quality DJ Streaming may result in an immediate termination of your service(s) and loss of data.
When cancelling an account through our support system, it is the user's responsibility to go to their PayPal account and cancel reoccurring charges as Quality DJ Streaming cannot not do this for you. In the event, user fails to or forgets to to do so, Quality DJ Streaming will refund (less PayPal fees) the first transaction after cancellation but will not be responsible to do so afterward.
Quality DJ Streaming shall not be liable for any taxes or other fees to be paid in accordance with or related to purchases made by the customer.
The user is solely responsible for all taxes, processing fees, and/or fees of any nature associated with all products and services.
Resellers will provide their own support to their clients. Quality DJ Streaming will help with issues that deal with our severs and will offer user help as a paid service only. See Paid Tech Support . Resellers will NOT advertise a competitor of Quality DJ Streaming at any time for any reason. This includes Personal profile pages in any and all social media, RLC, and Second Life. Doing so will result in immediate termination of the Reseller account.
Payments will be considered late one (1) day after due date and subject to the suspension of the stream.
Late Fee: A late fee of 10% will be assessed on the third (3rd) day and then every two days that the payment has not been received..
If payment has not been received five (5) days after payment is due services will automatically be suspended (unless special arraignments have been made).
If payment has not be received seven (7) days after payment is due services will automatically be terminated (unless special arraignments have been made).
All new users will be given 24-hour grace period. In the event one changes their mind they can email or submit a support tickets and request a 100% refund with no questions asked.
No refund will be given in the event that the user has in any way breached the TOU. This includes but not limited to exceeding the agreed bitrate limit, broadcasting unsuitable content or if user abuses bandwidth.
If your account is suspended or terminated due to non-payment, breech of the TOU, or any other reason, reinstatement of services is solely the discretion of the management of Quality DJ Streaming. If your account is approved for reinstatement, there will be a $5.00 (or equivalent virtual currency) processing fee that will need to be paid prior to the completion of the reinstatements
Customers who require technical support:
Calling or using Skype will result in immediate results (in most cases).
Support tickets and email support will be answered in the order they are received or by priority.
Quality DJ Streaming agrees to offer support to only clients on topics directly relating to our products and services. Our Technicians are here to assist clients with any problems directly relating to the availability or functionality of our streaming service(s), and billing issues. Our support service does not necessarily cover general computer, internet connection, or website advice.
We always try to assist our clients to the best of our ability. However, tech support for computer issues should be addressed by the manufacture of your computer, internet connection issues to your internet service provider (ISP) and so forth.
Our Support technicians also provides support remotely (currently using RemotePC) that you can download free by clicking here. This allows our Techs to troubleshoot your software, setup, etc. by accessing your system. Using the remote access option requires your approval for the tech to access your computer and in so doing, you agree to waive any liability to Quality DJ Streaming and Techs, and agree to make no claims against the Tech, and/ or Quality DJ Streaming for any issues that may arise as a result of this action. By providing the Access ID and Key you agree to these terms.
Quality DJ Streaming reserves the right at our sole discretion to close any account at any time without notice for any reason. A refund will not be provided, if your account is terminated due to a violation of the Terms of Service.
If a payment have not be received seven (7) days after payment is due, services will automatically be terminated.
If your account is terminated for any other reason, all uploaded music files, jingles, nitros will be deleted. There will be no refunds when an account is terminated.
In the event an account is terminated, any and all user information will be deleted from all our websites.
IN NO EVENT SHALL QUALITY DJ STREAMING OR ITS AFFILIATES AND/OR SUPPLIERS BE LIABLE FOR THE FOLLOWING:
1. ANY REPRESENTATION OR WARRANTY MADE TO ANY THIRD PARTY BY LICENSEE, ANY DISTRIBUTOR OR THEIR RESPECTIVE AGENTS;
2. FAILURE OF THE SERVICE TO PERFORM;
3. FAILURE OF THE SERVICE TO PROVIDE SECURITY OND/OR STABILITY;
4. THE RESULTS OR INFORMATION OBTAINED OR DECISIONS MADE BY END USERS OF THE PRODUCTS, SERVICES, OR THE DOCUMENTATION.
5. THESE LIMITATIONS OF LIABILITY ARE AN ESSENTIAL COMPONENT TO THIS AGREEMENT.AND BY SUBSCRIBING TO OUR SERVICES THE USER ACCEPTS THESE LIMITATION AND ALL COMPONENTS OF THIS AGREEMENT.
